Why and When is this Affidavit Used?
This declaration is used when applying for a minor child's passport and only one parent is giving consent because the other parent is abroad or travelling, is divorced/separated, has denied consent, is missing/abandoned, or there's a pending court case.
Purpose
- To legally explain why one parent's signature/consent is not attached.
 - To declare custody/responsibility of the minor by the applying parent.
 - To protect Passport Authority from future disputes by making the applying parent take responsibility.
 - To ensure the minor's right to a passport is not blocked due to disputes or absence of the other parent.

Q1. Is Annexure C mandatory if one parent is unavailable?
 - 
Yes. If both parents can't sign the application, this affidavit is compulsory.

Yes. The affidavit only covers consent, not parentage. Both parents' names will still be printed.

Q3. What if custody is disputed in court?

(c) The parents are divorced/judicially separated, and custody of the minor has been assigned to one parent (the parent who is applying for the passport), without visitation rights to the other parent. [Supporting Documents to be enclosed: Copy of court order/decree regarding divorce/judicial separation]
(d) The parents are divorced/judicially separated, and custody of the minor has been assigned to one parent (the parent who is applying for the passport), with visitation rights to the other parent. [Supporting documents to be enclosed: Copy of court order/decree regarding divorce/judicial separation; consent of her parent (having visit visitation rights) is also required.]
(e) There is an ongoing court case for divorce/judicial separation (including on the issue of custody of a minor child), and the court has not given any order prohibiting the issue of a passport without the consent of the father/mother. [Supporting documents to be enclosed: Copy of divorce petition/application]
(f) There is an ongoing court case for divorce/judicial separation (including on the issue of custody of a minor child), and there is a prohibitory order prohibiting the issue of a passport without the consent of the father/mother. (g) The parents are divorced/judicially separated, or there is an ongoing court case for divorce/judicial separation; however, the custody of the minor child has not been invoked/prayed in the divorce petition, or the custody of the minor is not disputed. 1. Non-submission of consent of the other parent is only for the issuance of the passport and will not have any bearing on mentioning the names of both parents in the passport.
2. Section 5 of the Passports Act 1967 read with Rule 5 of the Passports Rules, 1980 stipulates that the Passport Authority may make all such enquiries and may require an applicant to furnish such additional information, documents or certificates as may be considered necessary by the Passport Authority for the proper disposal of the application required.
