Why & When This Affidavit is Used

  • No Birth Certificate Issued – Common in older generations or rural areas where birth registrations weren't done.
  • Lost/Missing Records – When municipal/panchayat records are destroyed, misplaced, or unavailable.
  • Incomplete Birth Record – E.g., missing parent's name, incorrect details in the register.
  • For Legal/Official Use – Passport application, visa, school/college admission, pension, government job, Aadhaar, or property succession cases.
  • Court Proceedings – When proof of date/place of birth is required in any legal matter.

Purpose

  • Acts as secondary evidence of birth under the Bharatiya Sakshya Adhiniyam, 2023.
  • Provides a sworn declaration by a close relative or person having direct knowledge of the applicant's birth.
  • Helps government authorities or courts verify DOB when the official civil registration is absent.

Other Important Things

  • The affiant (person making the affidavit) should be a parent, grandparent, uncle/aunt, or someone present at the time of birth.
  • Should be attested before a Notary, Executive Magistrate, or Oath Commissioner.
  • Must clearly mention relationship, place of birth, date, and parents' names.
  • If used abroad (e.g., for US/Canada immigration), it should be on non-judicial stamp paper and notarised.
  • Some authorities may still ask for supporting documents like school records, hospital discharge slips, or Aadhaar to cross-check.

FAQs

Q1. Who can give a birth affidavit?

Usually parents. If not alive, close relatives like an uncle, aunt, or grandparent.

Q2. Is this affidavit valid instead of a birth certificate?

Yes, but only when the birth certificate is not available. Authorities may still ask for extra supporting proof.

Q3. Can I use it for making a passport?

Yes, Indian Passport Seva accepts it, but it must be accompanied by documents like a school leaving certificate.

Q4. Is it acceptable for government jobs and pensions?

Yes, but only if the birth certificate is not available and the affidavit is properly attested.

Q5. What if details in the affidavit and school records differ?

Then it may be rejected. All documents should show the same date of birth.

Q6. Can a friend give this affidavit?

No. Only someone with personal knowledge (preferably a relative) can swear it.

Q7. Is there punishment for a false DOB affidavit?

Yes. Giving false information is perjury and punishable under Sections 227–229 of the Bharatiya Nyaya Sanhita, 2023

Q8. Do I need stamp paper?

Yes, normally non-judicial stamp paper of ₹10/₹20, depending on state rules.

Q9. Is it valid internationally?

Yes, but for use abroad, it should be notarised and sometimes apostilled/attested by MEA.

Q10. How long is it valid?

It has no expiry. Once sworn, it stays valid until revoked or proven false.
