Why & When This Affidavit is Used
- No Birth Certificate Issued – Common in older generations or rural areas where birth registrations weren't done.
- Lost/Missing Records – When municipal/panchayat records are destroyed, misplaced, or unavailable.
- Incomplete Birth Record – E.g., missing parent's name, incorrect details in the register.
- For Legal/Official Use – Passport application, visa, school/college admission, pension, government job, Aadhaar, or property succession cases.
- Court Proceedings – When proof of date/place of birth is required in any legal matter.
Purpose
- Acts as secondary evidence of birth under the Bharatiya Sakshya Adhiniyam, 2023.
- Provides a sworn declaration by a close relative or person having direct knowledge of the applicant's birth.
- Helps government authorities or courts verify DOB when the official civil registration is absent.
Other Important Things
- The affiant (person making the affidavit) should be a parent, grandparent, uncle/aunt, or someone present at the time of birth.
