Why is this Affidavit/Declaration used?
- When an Indian citizen acquires citizenship of another country (India does not allow dual citizenship).
- To formally renounce Indian citizenship and surrender the Indian passport.
- Without this, you continue to be treated as an Indian citizen under Indian law, which may create legal issues.
When is it required?
- While acquiring foreign citizenship, you must submit it to the Indian Embassy/Consulate in that country.
- At the time of surrendering your Indian passport – before using/renewing your foreign passport.
- For applying for an Overseas Citizen of India (OCI) Card, proof of renunciation is mandatory.
- For immigration and property transactions in India, authorities may demand proof that you're no longer an Indian citizen.
Purpose
- To give the Government of India a legal record that you are no longer an Indian citizen.
- To prevent misuse of dual status (e.g., holding both Indian and foreign passports).
- To protect you legally: after renunciation, you are governed by foreign citizenship laws, not Indian citizenship obligations.
Important Notes
- Once renounced, Indian citizenship cannot be reclaimed automatically. You'd need to apply for fresh naturalisation if you want it back.
- Children also lose Indian citizenship if parents renounce, unless specifically exempted.
- Giving a false declaration is punishable under Bharatiya Nyaya Sanhita, 2023 (Sec. 227–229: false evidence, perjury, etc.).
