Purpose of the Affidavit

  • To declare that the applicant has completed an LL.B. from a recognised university/college.
  • To state the intended ordinary place of practice (as required by Bar Council rules).
  • To undertake transfer of enrolment if the lawyer shifts to another state.
  • To disclose gap years (if between graduation – LL.B. or LL.B. – enrolment).
  • To confirm that no false information is furnished.

Importance

  • Without this affidavit, the Bar Council will not process the enrolment applications.
  • It is proof that the candidate meets the eligibility criteria under the BCI Rules.

Q1. Is this affidavit mandatory for enrolment as an Advocate?

Yes. Every law graduate must file it with their enrolment form before the State Bar Council.

Q2. Which law requires this affidavit?

Section 24 and 49 of the Advocates Act, 1961 + BCI Rules (Part V, Chapter III, Rule 3).

Q3. Who can sign/attest this affidavit?

It must be sworn before a First Class Magistrate, Oath Commissioner, or Notary Public.

Q4. Why does it mention "transfer of enrolment"?

Because if you start practice in Delhi but later shift to, say, Maharashtra, you must transfer enrolment to the Maharashtra State Bar Council within 6 months.

Q5. What if there is a gap between graduation and LL.B.?

You must explain activities during that gap (e.g., job, studies, family support) in the affidavit — otherwise Bar Council may reject your application.

Q6. What if there is a gap after LL.B. before enrolment?

Again, you must explain (e.g., preparation for Judicial Services/UPSC, COVID delay, family reasons).

Q7. Can false declaration lead to cancellation?

Yes. If misrepresentation is found, enrolment can be cancelled and the person can be barred from practice.

Q8. Is this affidavit the same across all States?

The content is similar, but some State Bar Councils (like Delhi, Karnataka, and UP) may have slight variations in wording/format.

Q9. Can it be typed on plain paper?

No. It must be on non-judicial stamp paper of prescribed value (varies state to state).

Q10. After affidavit submission, what's next?

Bar Council scrutinises documents → Enrolment number is issued → Advocate becomes eligible to appear in AIBE (All India Bar Exam).

AFFIDAVIT

I, _________________________, son of ____________________, residing at _______________________________________________________________, do hereby solemnly affirm and state as follows:

  • That I have successfully completed the LL.B. examination from __________________ (name of university) in the year 2022 and have applied for enrolment as an Advocate with the Bar Council of Delhi. In my enrolment application, I have undertaken that my ordinary place of practice will be __________________.
  • That in the event I shift my place of practice from __________________ to any other State, I undertake to transfer my enrolment from __________________ to the respective State Bar Council within six months of such change, in accordance with Part V, Chapter III, Rule 3 framed by the Bar Council of India under Section 49(1)(ab) of the Advocates Act, 1961.
  • That I pursued my LL.B. as a regular student from __________________________ (name of college), situated at ______________________________________ (address of college). During the said period, I resided at __________________________, which was also the place where my LL.B. classes were regularly conducted.
  • That I undertake to furnish all details sought in the enrolment application truthfully, and I am aware that any misrepresentation or suppression of facts will render my enrolment invalid and liable to cancellation.

  •  That I completed my Graduation in the year _________ from __________________________. From _______ to _______, I was engaged in providing private tuition to children in order to support my family, and thereafter, in ________, I secured admission to LL.B. at ________________________ (name of college) located at ______________________________________.

  •  That after completing my LL.B., during the period from _______ to _______, I was preparing for the Judicial Services Examination. Further, due to the COVID-19 pandemic during this time, I could not apply for enrolment with any Bar Council.
