Why this affidavit is used

  • To declare the legal heirs of a deceased person.
  • To confirm who has the rightful claim over the property, bank account, insurance, pension, or other assets of the deceased.
  • To protect government authorities, banks, housing societies, and courts from false or multiple claims.
  • To provide a sworn statement when a legal heir certificate or succession certificate is yet to be obtained.

When it is used

  • Property matters – For transfer of ownership in property records (municipal records, society share certificate, mutation, etc.).
  • Bank/financial institutions – To claim deposits, accounts, fixed deposits, PF, gratuity, or loan clearance of the deceased.
  • Government benefits – For release of pension, insurance, or service-related dues.
  • Court cases – When heirs need to be disclosed in succession or inheritance disputes.
  • Housing society matters – To transfer society membership/room/flat in the heir's name.

Purpose

  • To establish a clear chain of legal heirs.
  • To prevent disputes or fraud regarding inheritance.
  • To serve as a temporary declaration until a legal heir certificate or succession certificate is issued by a competent authority.
  • To indemnify the authorities against future disputes.
Other Important Points
  • Must be executed on non-judicial stamp paper and notarised or attested by a Magistrate.
  • Usually accompanied by a death certificate, ID proofs, and family details.
  • Sometimes authorities still demand a legal heir certificate (issued by Tehsildar/SDM) or succession certificate (court-issued) along with this affidavit.
  • Acts as a supporting document, not conclusive proof of heirship.

FAQs

Q1. Who can give this affidavit?

Q2. Is this affidavit enough to claim property/assets?

Not always. Some authorities accept it with indemnity, but often a legal heir certificate or succession certificate is mandatory.

To protect the authority (bank, society, etc.) from future claims if other heirs come forward.
